Welcome to the Navien OptiSleep Affiliate Program (the “Program”). These Terms & Conditions (“Terms”) govern your participation as an affiliate (“Affiliate,” “you,” or “your”). By registering for or participating in the Program, you agree to be bound by these Terms.
1. Enrollment and Participation
Navien OptiSleep (“Navien,” “we,” “us,” or “our”) reserves the right to approve or reject any Affiliate application in its sole discretion. We may suspend or terminate participation at any time for violation of these Terms or for any business reason.
2. Affiliate Links and Promotions
Affiliates will be provided with tracking links and, where applicable, coupon codes.
- Tracking links may be used to promote Navien OptiSleep products
- Referral attribution is based on the most recent qualifying referral interaction
- Coupon codes may only be used if expressly assigned
- Affiliates may not promote unauthorized or expired promotions
Affiliates may promote through online and offline channels, provided such activities comply with these Terms and applicable laws.
3. Commission Structure and Payment
- Commission: Flat $250 per qualifying order
- Cookie duration: 30 days
A commission is earned when:
- A customer completes a valid purchase using your referral link or code, and
- The purchase is not cancelled, refunded, or returned within the 30-day trial period
Payment Conditions:
- Commissions are payable only after the 30-day trial period expires
- Orders resulting in refunds, chargebacks, or fraud will not qualify
- Navien reserves the right to review all referral transactions for compliance
Affiliates must provide accurate payment details to receive commissions.
4. Marketing and Advertising Requirements
Affiliates must comply with all applicable advertising and consumer protection laws.
(A) FTC Disclosure
Affiliates must clearly and conspicuously disclose their relationship with Navien OptiSleep in any promotion, including social media, in accordance with FTC endorsement guidelines.
(B) Claims Restrictions
Affiliates may only use claims that are consistent with Navien OptiSleep’s official marketing materials.
Affiliates may not:
- make medical, health, or therapeutic claims
- guarantee sleep outcomes or performance
- misrepresent product capabilities
(C) Brand and Trademark Use
Affiliates may use Navien OptiSleep trademarks and promotional materials only as provided or approved.
Affiliates may not:
- alter branding
- create misleading representations
- imply endorsement or partnership beyond the affiliate relationship
5. Prohibited Conduct
Affiliates may not:
- Engage in fraudulent or deceptive practices
- Use self-referrals or transact on their own behalf for commission
- Abuse coupon codes or tracking mechanisms
- Use spam, unsolicited communications, or unlawful advertising
Navien reserves the right to withhold or reverse commissions related to such conduct.
6. Cookies and Tracking
The Program uses cookies and tracking technologies to attribute referrals.
- If a customer disables or clears cookies, tracking may not occur
- Navien is not responsible for lost commissions due to tracking limitations
7. Termination
Affiliates may terminate participation at any time by contacting: optisleep@navien.com
Navien may suspend or terminate participation at its discretion.
Termination may result in forfeiture of unpaid commissions if these Terms are violated.
8. Limitation of Liability
Navien OptiSleep shall not be liable for indirect, incidental, or consequential damages arising from participation in the Program.
9. Modifications
We may update these Terms at any time. Continued participation constitutes acceptance of revised Terms.
