This Colorado Privacy Notice supplements Navien OptiSleep’s Privacy Policy and applies solely to residents of the State of Colorado. Navien OptiSleep (“we,” “us,” or “our”) complies with the Colorado Privacy Act (“CPA”).
I. Personal Data We Collect
Depending on how you interact with Navien OptiSleep, we may collect the following categories of personal data:
- Identifiers (such as name, email address, phone number, and device identifiers)
- Commercial information (including purchase history and order details)
- Internet and application activity (including browsing behavior, site interactions, and application usage)
- Device and application data (including device type, operating system, and diagnostics)
- Precise geolocation data (GPS latitude and longitude, when required for application functionality)
- Sensitive personal data collected through optional application features, including sleep-related information and audio-derived signals (such as breathing sound data), when expressly enabled by the user
- Inferences derived from personal data (such as preferences, usage patterns, or behavioral insights)
Sensitive personal data is collected only with your affirmative consent and only for the purposes described in this Notice. Sensitive personal data is not used for targeted advertising.

Sensitive personal data is not used for targeted advertising.
VII. Data Retention
We retain personal data only as long as reasonably necessary to fulfill the purposes described in this Notice, including:

- Customer service records for a limited period following resolution
- Data subject to legal obligations, disputes, or enforcement needs
Personal data collected through optional features is retained until service termination or withdrawal of consent, unless retention is required or permitted by law.

We use automated processing in connection with certain product features (such as temperature adjustments based on usage patterns).
These processes:
- are designed to enhance functionality and user experience
- do not produce legal or similarly significant effects
X. Global Privacy Control (GPC)
We recognize and honor Global Privacy Control (GPC) signals where required by law as a valid request to opt out of targeted advertising.
